Abstract

The general objective of the research was to legally analyze incestuous rape as an autonomous and independent crime in the Ecuadorian Organic Integral Penal Code. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview; the tool or instrument that supported it was the interview guide; which was applied to lawyers in free exercise of the profession with extensive theoretical and practical knowledge in the field of criminal law. Generating an analytical-reflexive process, contributing to the generation of the extension of the state of the art. It is concluded that overcriminalization in criminal law has several manifestations, among which it is worth mentioning the creation of new criminal types or the increase of the sanctioning framework in the existing ones without a valid justification of legislative technique.
